Many people confuse remonstration with a new application or complaint. Remonstration is a formal legal remedy. This page explains the process in general and does not replace an individual legal assessment.

Record the notice and document deadline information
Read the rejection letter completely. Write down the file number, delivery date and the reasons given. The information on legal remedies in the specific decision is decisive. Deadlines may vary depending on the procedure. Please do not check deadlines based on general online information alone.
Structure the documentation and open points
A factual and precise structure is helpful for preparation. These include: (1) clear reference to the notice, (2) orderly representation of the open points, (3) comprehensible allocation of evidence. An authorized body should be consulted for legal assessment and formulation.
Collect and attach new documents
The remonstrance relies on new facts or evidence that were missing or incorrectly assessed in the first application. Simply repeating what was already in the first application is not enough. All new documents must be certified and translated into German or English. Create a document list that gives each piece of evidence a number.
Submission to the office named in the notification
The submission should be made to the office named in the notice. In writing by post or in person. Email will only be accepted if expressly stated. Registered mail with return receipt recommended to prove receipt. Keep copies of all documents for yourself.
Wait for processing and document
The responsible office processes the process according to internal processes. The duration can vary greatly. Keep all input and response data documented. If deadlines are running, legally authorized assistance should be involved.
Receive a decision and plan next steps
After the decision, the notice, deadlines and other options should be sorted. In the event of deadlines, rejections or legal disputes, a legally authorized body should be contacted immediately. The binding decision is made exclusively by the responsible body.

Common Error: Submit the same documents again as for the first application - without any additions or corrections. The BVA only checks whether the original rejection was legal. Without new facts nothing changes.
Structure of the letter of remonstration
An effective letter of remonstrance is not a creative task - it follows a fixed pattern. Anyone who deviates from this risks having their remonstrance rejected as unfounded.
Subject and reference
"Remonstration against the decision of [date] – file number [number]"
Clear assignment from the start. Without a file number, the remonstrance will not be assigned.
Application
"I protest against the above-mentioned decision and ask that the rejection or granting of the visa be revoked."
Clear and unmistakable. No paraphrases.
Justification
"The reason for rejection [paragraph] does not apply because..."
Factually, selectively, with evidence. Not emotional, not didactic.
Signature and attachments
Handwritten signature, place, date.
Plant directory with numbering. Each attachment must be mentioned in the text.
Tip: Keep the letter to a maximum of 2-3 pages. Authorities don't read novels. The more precise the argument, the higher the chance that a clerk will take it seriously.
Common errors in remonstration
Most remonstrations fail not because of the law, but because of the form. If you avoid these mistakes, you can present your own initial situation in a more structured way.
- Missed deadline – The 1 month period is absolute. No leniency, no recovery possible.
- No file number – The embassy cannot find the case without a file number. The remonstration will not be processed.
- Emotional language – “Unfair”, “arbitrary”, “incomprehensible” are not legal arguments. They do harm.
- No new evidence – Repeating the old things is not enough. The BVA only checks whether the first decision was wrong.
- Wrong address – Send directly to the BVA instead of to the embassy. The embassy has to forward it – that takes weeks.
- No signature – A signed remonstration is invalid. This also applies to email attachments.
- Remonstrated several times – Submitting the same thing multiple times annoys the authorities and leads to a ban.
Warning: Some dubious service providers on the Internet offer “guaranteed remonstrations”. There are no guarantees in official procedures. Reputable lawyers give realistic chances of success - no promises.

The remonstration itself is free of charge. But preparation can come at a cost – and if you fail, it will be expensive. Knowing what happens beforehand and what threatens later helps you decide for or against professional help.
