It is not a variant of the self-employed visa – it follows its own rules and does not require a business plan and is not assessed according to the economic interest of the general public.

Freelance professions under German law – a closed list

Tax law (§ 18 EStG) defines who is considered a freelancer. This definition is binding - anyone who does not fall under it needs the self-employed visa, not the freelancer visa.

What applies to the freelancer visa

The freelancer visa has fewer formal hurdles than the self-employed visa – but a crucial one: For regulated professions, a professional license is required before entry. Without it, no professional practice is legal.

01 Requirements

Qualifications, permits and financing

Compare self-employed visas

1. Proof of freelance work

The activity must correspond to one of the catalog professions according to Section 18 EStG or be comparable to such an activity. The tax office ultimately classifies whether an activity is recognized as a freelance job. If in doubt, obtain information in advance from the responsible tax office.

2. Professional license for regulated professions

Doctors, dentists, pharmacists, lawyers, architects and engineers (depending on the federal state) are regulated professions. You are allowed in Germany only work with a German professional license. This permit must be applied for before entry – it is issued by the responsible chamber or state authority.

3. Proven qualifications

University degree or equivalent professional qualification, certified copies and translations into German. In the case of regulated professions, the additional Recognition notice from the German chamber.

4. Proof of secure livelihood

No blocked account, no minimum capital - but: the embassy checks whether livelihood is secured during the stay. Order confirmations, fee contracts or savings are suitable evidence. The goal: no dependence on state services.

The strictest requirements apply to doctors: approval by the responsible medical association, knowledge check if they have non-EU training, and if necessary, a specialist language test at C1 level. This process can take 6-18 months and should be completed before the visa application.

Specialist language test for doctors

Doctors with non-EU training usually have to pass a specialist language test at C1 level at the relevant medical association. This exam tests medical German - not general language level. Preparation: 3-6 months of targeted learning, registration 2-4 months in advance.

Anyone who works as a doctor in Germany without a license to practice medicine is committing a criminal offense. The professional license must be obtained before starting work - not just after entry and registration. The visa alone does not entitle you to practice your profession.

Optional but effective

  • Order confirmations or fee contracts from German clients – significantly strengthen credibility
  • Membership in a German professional association – shows integration into the German professional community
  • Knowledge of German – No statutory level required, but expected for professional use in Germany
  • Portfolio or work samples – with artists, journalists, graphic designers
Order confirmations from Germany are the strongest signal for the message: They show that freelance work in Germany is not only planned, but has already been initiated. Anyone who establishes contacts with German clients before entering the country significantly increases the likelihood of approval.
Important

For regulated professions, the recognition process begins months before the visa application. Anyone who starts doing this after entering the country is working illegally until they receive permission.

Have your job classified as a freelance job

Check whether the planned activity corresponds to the German definition of freelance work according to Section 18 EStG. In borderline cases, contact the responsible tax office Information on tax classification obtain – before applying for the visa.

Apply for a professional license from the chamber

For regulated professions (doctor, lawyer, architect): Application to the responsible chamber in the federal state of the planned place of work. Duration: 3-18 months depending on the profession and completeness of the documents.

For doctors: prepare the C1 technical language test at the same time - it is part of the recognition process.

Secure fee contracts, letters of intent or order confirmations from Germany – before the embassy appointment. This step is not a mandatory document, but it significantly increases the likelihood of approval.

Entering the country and registering freelance work
